The Textile Productions Identification Act, which was enacted in 1958, did not account for the hundreds of thousands of items being uploaded to e-commerce websites every day.
In 2024, the All-American Flag Act was passed by Congress, requiring that all flags purchased by the Federal Government be 100% made in America. This first bill was a huge win for American flag makers, signaling a positive change in regulatory oversight.
However, while a great first step, the All-American Flag Act only applies to federal purchases exceeding $200,000 and doesn't address fraudulently labeled flags. Another positive step toward stopping fraudulent labeling happened in early 2025. President Trump closed the de minimis loophole, an often-used tactic from foreign companies to undercut American workers.
The great news is that the Make American Flags in America Act (HR 1421), was recently reintroduced to the Senate and House. The bill is sponsored by Senators Ted Cruz (R-TX), Thom Tillis (R-NC), Rick Scott (R-FL), and Representatives Greg Landsman (D-OH) and Nick Langworthy (R-NY).
It aims to expand e-commerce regulatory oversight and lessen deceptive marketing practices found in the flag industry. To help promote transparency, the bill requires the FTC to conduct an in-depth study into fraudulently labeled American flags.
HR 1421 was written with the help of U.S. flag retailers and manufacturers, making it the only one to specifically address deceptive advertising, flag fraud, and other major issues that threaten domestic flag manufacturing. The result promises to be unprecedented transparency within the flag industry.
